# Terms and Conditions

Welcome to Sign With Sam ( www.signwithsam.net ). By requesting, scheduling, or utilizing our mobile notary or document services, you agree to be bound by the following Terms and Conditions.

### 1. Scope of Service & Scheduling

* **Mobile Notary Services:** Sign With Sam provides mobile notarization and document witnessing services. We are not a process server, legal courier, or delivery service. Courier, delivery, or drop-off of notarized documents to third parties (e.g., FedEx, UPS, title companies) is not included unless explicitly contracted in writing prior to appointment dispatch.

* **Scheduling & Confirmation:** All appointments booked online or by phone are subject to availability and explicit confirmation by Sign With Sam over the phone or via email. 24/7 service availability is subject to notary availability and safety constraints.

### 2. Statutory Fees & Travel Charges

* Notarial act fees are charged in strict accordance with Texas Government Code § 406.024.

* Travel fees, after-hours premiums, wait time fees, and administrative/copying fees are separate, non-statutory service charges negotiated and agreed upon prior to dispatch.

* **Base Travel Rates:** $50.00 for up to 20 miles from Plano, TX, and $0.76 per additional mile for distances between 21 and 100 miles.

* **After-Hours Rates:** Additional premiums apply as posted on our Pricing page ($30 additional for 5:00 PM–9:00 PM; $50 additional for 9:01 PM–Midnight; variable rates for 12:01 AM–6:00 AM, weekends, and holidays).

### 3. Payment Terms

* Total itemized fees are due in full at the time of service upon arrival.

* Accepted payment methods include Cash, Credit/Debit Cards (via Square), Zelle, Chime, Venmo, Cash App, Check, and PayPal.

* Document copies ($1.00 per page) or administrative printing/scanning services will be added to the final itemized receipt.

### 4. Cancellation, Wait Time, & No-Show Policy

* **Cancellations:** If an appointment is canceled within two (2) hours of the scheduled time, a **$30.00 cancellation fee** will apply.

* **Travel Charges on Cancellation:** If the notary has already dispatched or traveled for your appointment prior to cancellation, the standard travel fee ($0.76 per mile traveled or base travel fee) will be charged in addition to the $30.00 cancellation fee.

* **Wait Times:** A standard grace period of 10 minutes is allowed upon notary arrival. Thereafter, a wait time fee of **$45.00 per 30-minute period** will be added to the invoice.

* **No-Shows & Default:** If a client fails to appear within 15 minutes of the agreed arrival time, the appointment will be deemed a No-Show, subject to the full Cancellation Fee and accrued Travel Fees. Unpaid cancellation fees will be electronically invoiced and are due upon receipt.

### 5. Identification Requirements & Refusal of Service

Under Texas law, the notary reserves sole discretion to decline or terminate service under the following circumstances (applicable Travel and Cancellation fees still apply):

1. **Identification:** Signers must present a valid, unexpired government-issued photo ID,  containing a signature and physical description (e.g., Texas Driver's License/ID Card, U.S. Passport, U.S. Military ID, or Foreign Passport stamped by US CIS).

2. **Lack of Capacity or Duress:** If the notary reasonably determines that any signer lacks mental capacity, awareness, or is acting under coercion or duress.

3. **Incomplete Documents:** Documents containing blank spaces intended to be filled prior to notarization cannot be notarized under Texas law.

4. **Foreign Language Documents:** Notarial certificates must be written in English. The notary reserves the right to decline foreign language documents if completeness or identity cannot be verified safely.

### 6. Weather & Force Majeure

* Sign With Sam reserves the right to cancel, delay, or reschedule appointments due to severe weather, hazardous driving conditions, road closures, or unpreventable emergency events without penalty or liability.

### 7. Limitation of Liability & Legal Disclaimer

* **Non-Attorney Notice:** Sign With Sam is not a law firm. Our notaries are not attorneys licensed to practice law in the State of Texas and may not give legal advice or accept fees for legal advice.

* Sign With Sam maintains Errors & Omissions (E&O) insurance. To the maximum extent permitted by law, our total financial liability for any claim arising out of services rendered shall not exceed the total fees paid by the client for that specific appointment.

All appointments are subject to availability and confirmation. 

Final cost will be determined at the time of service.
